Under
the
New North Carolina ATV Safety
Law Senate Bill #189, children
under the age of 8 years are no
longer allowed to ride/pilot an
ATV of any size. Children 8
years through 11 years are
allowed on ATVs with an engine
size of 69 cc's or less.
Children 12 years through 15
years old are allowed on ATVs
with an engine size between 70
and 90 cc's. Children 16 years
and older are allowed to ride
ATVs with an engine size greater
than 90 cc's.
No child in
North Carolina can legally ride
any ATV until
they have taken and passed an
ATV Safety Training Course
Sponsored or Approved by the ATV
Safety Institute. This became
LAW Jan. 1 2007.

Permission
to Ride
A birth
certificate for all minor children is
required (anyone under age 18).
The minor's birth certificate MUST show BOTH
birth parents' names.
Please furnish
a photocopy of both birth parents' drivers
licenses. If only one parent accompanies the
minor child to the BMMS Park, then the
absent parent MUST sign the Minor
Release Form and have their
signature notarized. Otherwise, the minor
child WILL NOT be permitted to use the
Park's trails. There are
NO EXCEPTIONS to this rule. If one
Parent is deceased we need a copy of the
Death Certificate.
Please make
sure that you review your birth certificate
to ensure the required information is
listed. If you have any questions regarding
a minor child being able to ride, please
call the Park at (828) 635-7766 and we will
do our best to answer your questions.
The birth
certificate photocopy and minor release form
for child riders will be held on site for 12
months.

Attention ATV
Riders!
- Tire
Notice -
BMMS Park
will no longer allow aggressive, deep tread
tires to be used at the Park. These
tires can best be described as Swamper,
Mudder, Paddle, or Agricultural Type Tractor
tires. We do this in the best interest of our
trails and the majority of our riders. We are
sorry if this impacts you. If you have any of
the above type tires, please make sure to
measure your tire height BEFORE coming to the
park to ride. Maximum allowed tire tread
height on ATVs is 3/4 of an inch. |
Current Conditions at
Brushy Mountain

All riders
must wear DOT approved helmets, gloves,
goggles, long pants, shirts,
and boots that come above
the ankles while riding.
-
Any rider
found to be disturbing, harassing, or
chasing wildlife will be subject to
expulsion from the park.
-
NO
alcohol or drugs allowed. Violation of this rule will
result in immediate
expulsion from park.
-
All
non-participating children MUST be
supervised by a parent at ALL times.
-
All trails
and tracks are ONE WAY ONLY.
Markers on each trail/track indicate
direction of traffic. Riders who
do not follow the Trail markers and
Trail arrows are subject to expulsion
from the park.
-
No riding
on the entry road - For cars and trucks
only.
-
All riders
MUST stay on designated trails at
all times.
-
No riding
on trails marked CLOSED.
-
NO
weapons are allowed within park areas. Violation of this rule will
result in immediate
expulsion from the park.
-
Reckless or
dangerous riding that could be harmful
to self or others is not permitted.
-
Non-riders
are NOT allowed to leave the
designated parking or spectator areas.
-
NO
passengers on motorcycles or ATVs is
permitted under any condition, with the
exception of new model ATVs designed as
2-seaters.

Vehicle
Retrieval Charges
Sometimes vehicles get stranded
and need help getting back to home
base. It happens. BMMS offers
a vehicle retrieval service for stuck
rides at the park. However, due to
the ever increasing cost of business,
Brushy Mountain Motor Sports Park has
found it necessary to start charging for
the retrieval of bikes, ATVs and
side-by-side vehicles.
The
breakdown for vehicle retrieval charges is:
$25.00 dirt bike
$35.00 atv-sport or utility quad
$50.00 side by side
No
retrieval will be done after normal park
hours.

SIDE BY SIDE ATV UPDATE 7/5/08
Starting Aug. 1, 2008 Brushy Mountain Motor
Sports Park will allow the new side by side
seating Yamaha Rhinos, Polaris Ranger, Polaris
Razor, Kawasaki Mule, Kawasaki Teryx and
similiar other models as they are released.
HOWEVER, NO go carts, golf carts, rail
buggies, dune buggies, trucks, jeeps or six
wheeled vehicles will be allowed to us the
Parks trails.
There is a two person limit per side
by side vehicle and all drivers and passengers
MUST possess a valid state drivers license and
be 16 years of age or older. All BRUSHY
MOUNTAIN MINORS RELEASE FORMS and
associated documents are required for all
Drivers and passengers under 18 years of
Age. DOT-approved helmets and eye
protection are required to be worn by BOTH
driver and passenger at ALL TIMES along with
the vehicle seatbelt. There is a maximum
allowed 60-inch overall width on all side by
sides and a maximum allowed tire tread height
of 3/4 of an inch.
The price to ride any of the approved Side by
Side vehicles is $30.00 per vehicle with a two
person limit. No cost for the passenger. The
yearly membership cost for an individual side
by side member is $350.00 and the Family
Membership cost is $500.00 for up to four
persons the age of 16 or older. There is
a limit of two side by side vehicles per
Family Membership. (This applies to immediate
family only. Example: a father, mother
and two children the age of 16 or older or
parent and three children the age of 16 or
older.)
Please be Advised: Brushy Mountain Motor
Sports Park's Rules and Regulations are just
that, RULES and REGULATIONS. They are not
suggestions. Violators will be ejected
from the park; no second chances, no excuses.

COOLER POLICY
To help maintain the
highest levels of quality among our
riding trails, BMMS Park has implemented
a new cooler policy. Coolers
are
no
longer
allowed
beyond
the
parking lot areas. Coolers will not be
allowed on any of the riding trails.
Riders violating this policy will not
be allowed to ride at the Park.

Due to
insurance regulations, if only one
parent accompanies the minor child to the
Park, then the absent parent MUST have
their signature notarized, otherwise the child
will NOT be allowed to use the Park
facilities. No exceptions to this
rule. If only one parent will be at the
Park, the signature of the missing parent must
be notarized. Legal custody of a
minor child will NOT be accepted for
birth parents signature.
In
addition, Birth Certificates must
show Birth Parent's names on the
birth certificate or minor children
will NOT be allowed to ride at
the Park. If one Parent is deceased we
need a copy of the Death Certificate. Please
make sure that you review your Birth
certificate to ensure the required
information is listed.

| ATV
& Motorcycle Riders Must Take
Responsibility For Their Actions!
ATV &
Motorcycle Riders Should :
- Get Landowner permission before
operating your ATV or Motorcycle.
- Respect private property you do
have permission to operate your ATV or
Motorcycle on so you do not cause damage
to the property.
- Take an ATV or Motorcycle
education course and pass on your
education.
- Stay on designated trails at all
times. Failing
to will jeopardize permission to use the
land in the future.
- Avoid operating an ATV or
Motorcycle when conditions may cause
excessive damage to the land and other
natural resources. This will cause erosion
problems. Especially during mud season in
the spring or fall.
ATV &
Motorcycle Riders Should Not:
- Operate an ATV or Motorcycle on a
private road without landowner permission.
- Operate an ATV or Motorcycle on or
along railroad tracks within right of way
of a railroad. Abandoned
tracks or removed tracks still require
landowner permission.
- Operate an ATV or Motorcycle
within 200 feet of any dwelling, hospital,
nursing home, convalescent home or church.
- Operate an ATV or Motorcycle on
any salt marsh, inter-tidal zone, marine
sand beach, sand dunes, cemetery or burial
place, alpine tundra or unfrozen
freshwater bog or marsh.
- Operate an ATV or Motorcycle on
any crop land or pasture land or tree
plantations.
Tips on
Operating Your ATV and Motorcycle!
- Be prepared: Take a
safety course, make sure you and your ATV
or Motorcycle are insured.
- Know the area you are
riding in: Be
aware of terrain and weather conditions.
- Remember it's fun but don't get
hurt. Wear protective gear:
Helmet, eye protection, long pants
and shirt, solid shoes or boots and
gloves.
- Use
good judgment: Maintain proper speed for
the terrain, visibility and your
experience.
- Remember
an ATV or Motorcycle is a motorized
vehicle and you should NEVER drink and
drive.
